Newport Aiming For New Land Court Hearing On Asphalt Plant

Newport Materials once again will be seeking an appeal in Massachusetts Land Court after opposition from the Westford Planning Board.

Recently, Newport Attorney Thomas Reilly filed a complaint in Land Court against the town as well as the Planning Board, appealing the Planning Board’s decision not to approve a Major Commercial Project special permit.

In the 29-page brief, Reilly claims that the Planning Board violated Westford zoning bylaws, particularly interpretations of the bylaws provided by the Land Court during a previous appeal.

The Land Court judge assigned to the case is the Hon. Gordon H. Piper, no court dates have been announced as of May 28.
